  1. Acceptance of Terms

By engaging BENNY IT SERVICES PTY LTD for any digital service — including website development, digital marketing, e-commerce business setup, or drop shipping store creation, domain and hosting services — you are agreeing to the following Terms and Conditions. If you do not agree, please discontinue use of our services.

  1. Scope of Services

BENNY IT SERVICES PTY LTD provides the following services:

  • Website design, development, and maintenance
  • Digital marketing (SEO, social media marketing, paid advertising, and branding)
  • E-commerce store setup and management
  • Drop shipping business development and consulting
  • Domain & Hosting services providing

Each project’s details, scope, deliverables, and pricing are outlined in the written quotation or service proposal provided to the client prior to commencement.

  1. Client Responsibilities

The client agrees to:

  • Provide all necessary content, materials, approvals, and access (e.g., hosting, domain, platforms) in a timely manner.
  • Ensure that all content provided does not infringe on any intellectual property rights.
  • Maintain compliance with applicable Australian laws, including those related to online commerce, data privacy, and advertising standards.
  • Manage business operations such as order fulfillment, logistics, and customer communication for e-commerce and drop shipping services.
  1. Payment Terms and Model
  • Projects operate on a 50/50 payment model:
    • 50% deposit is required to begin work.
    • The remaining 50% balance is due upon completion of the project or upon final delivery.
  • All invoices are payable within 7 days of issue unless otherwise agreed in writing.
  • Late payments may incur a 5% administrative fee every 14 days until payment is received.
  • Due to the digital nature of our services, refunds are only available prior to commencement of work or in exceptional cases where no deliverables have been created.
  1. Intellectual Property Rights
  • Full ownership of the final deliverables (e.g., website design, content, or branding) transfers to the client once full payment is received.
  • BENNY IT SERVICES PTY LTD retains ownership of underlying tools, code libraries, frameworks, and templates developed or owned prior to the project.
  • The client grants BENNY IT SERVICES PTY LTD permission to display completed work in its portfolio, unless otherwise agreed in writing.
  1. Third-Party Services and Hosting
  • Clients are responsible for domain registration, hosting accounts, and any third-party subscriptions (e.g., Shopify, WordPress plugins, Google Ads).
  • BENNY IT SERVICES PTY LTD is not liable for any downtime, security incidents, or performance issues caused by third-party providers.
  1. Marketing and Performance Disclaimer

BENNY IT SERVICES PTY LTD commits to providing professional and ethical marketing and development services. However, specific outcomes such as sales, rankings, or traffic growth cannot be guaranteed due to fluctuating market and platform conditions.

  1. Revisions and Support
  • Each project includes a defined number of revisions, as outlined in the quotation. Additional changes beyond this scope may incur extra charges.
  • Free technical support is provided for 30 days after final delivery. Ongoing maintenance or marketing management can be arranged through a separate service agreement.
  1. Confidentiality

All information shared by the client will be treated as confidential and used solely for completing the contracted services. BENNY IT SERVICES PTY LTD will not disclose client data to third parties without consent, except when legally required.

  1. Limitation of Liability

While all reasonable care is taken, BENNY IT SERVICES PTY LTD shall not be liable for:

  • Loss of business, income, or data resulting from the use or misuse of our services.
  • Errors or damages caused by third-party tools, hosting providers, or platforms.
  • Client-modified work after delivery.
    Our maximum liability shall not exceed the amount paid by the client for the related project.
  1. Termination of Services

Either party may terminate the agreement with written notice if obligations are not upheld. The client must pay for all completed work and expenses incurred up to the date of termination.

  1. Governing Law

These Terms and Conditions are governed by the laws of Western Australia. Any disputes shall be resolved under the exclusive jurisdiction of the courts of Perth, Western Australia.

  1. Updates to Terms

BENNY IT SERVICES PTY LTD reserves the right to update or amend these Terms and Conditions at any time. Updated terms will be posted on our official website and will apply to new projects or renewals thereafter.
